Abstract

Hukum di Indonesia semakin hari semakin berkembang, mengikuti perkembangan dan fenomena yang terjadi di tengah masyrakat, salah satunya adalah doktrin ultimum remedium. Ultimum remedium secara sederhana dikenal sebagai salah satu asas yang terdapat di dalam hukum pidana Indonesia, yang mengatakan hukum pidana hendaklah dijadikan upaya terakhir dalam penegakan hukum dan dianggap masih terdapat suatu alternatif penyelesaian lain selain menerapkan suatu aturan hukum pidana. Maka, untuk menegakan supremasi hukum admisitrasi yang sering dianggap sebagai hukum yang “lemah”, hukum pidana dijadikan sebagai pelengkap yang dapat memberikan dampak penerapan hukum yang maksimal agar terciptanya keadilan ditengah masyarakat. namun, pada prinsipnya, penggunaan doktrin ultimum remidum ini tidak boleh dierapkan secara sembarangan, harus dengan pertimbangan yang melihat kasus hukum yang terjadi. Penelitian ini menggunakan metode penelitian dengan pendekatan yuridis-normatif. Data yang dikumpulkan dilakukan dengan menggunakan teknik library reseach atau studi pustaka. Bahan hukum yang digunakan pun berupa bahan hukum primer yang meliputi yang meliputi peraturan-peraturan yang terkait. Kemudian didukung pula dengan bahan hukum sekunder dan tersier yang semakin melengkapi substansi penelitian. Hasil penelitian ini menunjukan betapa pentingnya penegakan hukum yang kuat guna menciptakan keteraturan dan keadilan ditengah masyarakat. Fokusnya adalah pada penguatan hukum administrasi oleh hukum pidana melalui asas ultimatum remedium. Sehingga, cita-cita akan keadilan dan keteraturan sebagaimana yang tergambar pada sila ke lima Pancasila dapat diwujudkan. Kata Kunci : Ultimum Remedium, Hukum adminstrasi, Hukum Pidana (Law in Indonesia is growing day by day, following developments and phenomena that occur in society, one of which is the ultimum remedium doctrine. Ultimum remedium is simply known as one of the principles contained in Indonesian criminal law, which says criminal law should be used as a last resort in law enforcement and it is considered that there is still an alternative solution other than applying a criminal law rule. So, to uphold the supremacy of the law of admission, which is often considered a "weak" law, criminal law is used as a complement that can have a maximum impact on the application of law in order to create justice in the community. however, in principle, the use of the ultimum remidum doctrine should not be applied arbitrarily, it must take into account the legal case that occurred. This study uses a research method with a juridical-normative approach. The data collected is done by using library research technique or literature study. The legal material used is also in the form of primary legal material which includes related regulations. Then it is also supported by secondary and tertiary legal materials which further complement the research substance. The results of this study show the importance of strong law enforcement in order to create order and justice in society. The focus is on strengthening administrative law by criminal law through the ultimatum remedium principle. Thus, the ideals of justice and order as described in the fifth principle of Pancasila can be realized. Keywords: Ultimum Remedium, Administrative Law, Criminal Law)
