Abstract
Tujuan diadakannya penelitian ini adalah untuk menemukan jawaban dan kepastian hukum terkait dengan tanggung jawab pidana terhadap seorang yang dikatakan psikopat dan juga mencari kepastian hukumnya apakah seorang psikopat dapat dijatuhkan hukuman pidana dengan menggunakan Pasal 338 KUHP. Peneliti menggunakan Jenis Penelitian Hukum Normatif yang bertujuan untuk menemukan aturan hukum, prinsip-prinsip hukum, serta doktrin-doktrin hukum yang sebenarnya guna memberikan jawaban dan memecahkan sebuah permasalahan terhadap isu hukum yang sedang diteliti. Dengan menggunakan konsep yang sudah peniliti buat, serta peneliti ingin menjelaskan terkait pertanggungjawaban pidana bagi seorang psikopat yang telah melakukan tindak pidana pembunuhan, serta menentukan aturan hukum mana yang tepat dan dapat dijatuhkan kepada seorang psikopat, sekaligus menjelaskan bahwa seorang psikopat berbeda dengan seseorang yang mengidap gangguan kejiwaan, sehingga dapat dijadikan acuan atau perbandingan untuk dijatuhkannya hukuman pidana. Dan juga mencari jawaban dapat dilihatnya seorang yang mengidap gangguan psikopat dari berbagai pandangan publik untuk memberikan kepastian hukum. Sehingga dapat memberikan jawaban serta referensi bagi masyarakat luas terkait pertanggungjawaban pidana terhadap seorang psikopat.
