Abstract
Pelecehan seksual menjadi suatu masalah sosial yang sampai sekarang masih marak di temui, baik langsung maupun melalui media online seperti Instagram, Twitter Facebook, Youtube, Whatsap, dan TikTok. Bagaimana bentuk penerapan tindak pidana tersebut masih terkesan multy tafsir meskipun kejahatan itu terus terjadi . Atas dasar latar belakang hal tersebut maka penelitian ini memberikan fokus kepada bagaimanakah penerapan hukum tindak pidana Pelecehan Seksual melalui Media online di Indonesia. iJenis ianalisis iyang idigunakan adalah ianalisis ihukum inormatif idengan imenggunakan ipendekatan ihukum idan pendekatan ikonseptual. iBahan ihukum iyang idigunakan iterdiri idari ibahan ihukum primer idan ibahan ihukum isekunder. iTeknik ipengumpulan ibahan ihukum idilakukan denganiiteknik kepustakaan. Teknik analisis bahan hukum yang digunakan adalah analisis perskriptif, analisis ini menggunakan bahan-bahan yang sudah diperoleh kemudian disusun secara sistematis yang kemudian akan dianalisis. Hasil dari penelitian ini adalah bahwasannhya sebelum adanya UU TPKS, penerapan hukum tindak pidana pelecehan seksual melalui media online tidak diatur secara khusus dalam Undang-Undang yang telah ada. Sehingga dalam penyelesaiannya dapat menggunakan beberapa aturan perundang-undangan seperti KUHP, UU Pornografi, dan UU ITE. Hal tersebut yang menyebabkan dapat terjadinya dua atau lebih kasus yang serupa dapat berbeda aturan perundang-undangan yang digunakan pada masing-masing kasusnya. Sehingga Undang-Undang yang ada tersebut dapat saling tumpang tindih dalam penerapannya pada kasus pelecehan seksual melalui media online. Kata Kunci: Pelecehan seksual, media online, Tindak Pidana (Sexual harassment is a social problem that is still widely encountered, both directly and through online media such as Instagram, Twitter, Facebook, Youtube, Whatsap, and TikTok. How the form of the application of the crime still seems to have multiple interpretations even though the crime continues to occur. Based on this background, this research focuses on how to apply the criminal law of sexual harassment through online media in Indonesia. The type of analysis that is used is an informative legal analysis using a legal and conceptual approach. The legal materials used consist of primary legal materials and secondary legal materials. The technique of collecting legal changes is carried out using the library technique. The legal material analysis technique used is descriptive analysis, this analysis uses materials that have been obtained and then arranged systematically which will then be analyzed. The results of this study are that before the TPKS Law, the application of the law on sexual harassment through online media was not specifically regulated in the existing law. So that the settlement can use several laws and regulations such as the Criminal Code, the Pornography Law, and the ITE Law. This causes two or more similar cases to occur which may differ in the laws and regulations used in each case. So that the existing laws can overlap each other in their application to cases of sexual harassment through online media. Keywords: Sexual harassment, online media, crime)
