Abstract

Ketentuan pidana diatur dalam KUHP. Dibentuk oleh lembaga legislatif untuk memberikan perlindungan terhadap perbuatan asusila atau penjahat, dan tingkah laku berupa perkataan atau perbuatan yang tidak etis terhadap akhlak yang baik. Hal ini karena berkaitan dengan kebiasaan kehidupan seks penduduk setempat, bertentangan dengan pengertian validitas masyarakat dalam bidang kehidupan seks di mana kata-kata diucapkan dan tindakan dilakukan.Atas dasar permasalahan di atas, maka peneliti memberikan focus rumusan masalah tentang Bagaimana Penegakan dan perlindungan hukum terhadap pelaku pelecehan seksual secara verbal di Indonesia . Metode penelitian ini menggunakan metode penyidikan yuridis normatife, untuk menganlisis tentang asas asas hukum . Hasil penelitian menemukan bahwa penegakan hukum berupa tuntutan awal pelecehan seksual secara lisan belum berhasil karena hambatan dalam prosesnya. Pembatasan tersebut meliputi faktor hukum itu sendiri, faktor penegakan hukum, dan faktor masyarakat. Kedua, pencegahan kejahatan terjadi dalam beberapa tahap: pengembangan, implementasi, dan eksekusi. Hukum Acara Pidana juga perlu mempertimbangkan dua hal pokok dari kebijakan hukum pidana. Sedangkan dalam Perlindungan korban kekerasan verbal dengan Catcalling adalah Pasal 5 Undang-Undang Nomor 31 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 13 Tahun 2006 tentang Perlindungan Saksi dan Korban, Pasal 5 Undang-Undang Nomor 31 Tahun 1999. Hal ini dapat dilakukan melalui hak-hak yang terkandung dalam UU Hak TPKS No. 12 Tahun 2022. Kata kunci : Kebijakan Hukum Pidana - Perlindungan Hukum - Pelecehan Seksual (Criminal provisions are regulated in the Criminal Code. This is because it relates to the sex life habits of the local population, contrary to the notion of community validity in the field of sex life where words are spoken and actions are taken. verbal sexual harassment in Indonesia. This research method uses a normative juridical investigation method, to analyze the legal principles. The results of the study found that law enforcement in the form of initial demands for verbal sexual harassment had not been successful due to obstacles in the process. These restrictions include legal factors themselves, law enforcement factors, and community factors. Second, crime prevention occurs in several stages: development, implementation, and execution. The Criminal Procedure Code also needs to consider two main points of criminal law policy. Meanwhile, in the protection of victims of verbal violence by Catcalling is Article 5 of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims, Article 5 of Law Number 31 of 1999.
