Abstract

Trafficking of women under the guise of marriage or marriage orders is dangerous because these cases reach one of the countries that frequently order, namely China. Many of the victims were women who were there instead of married, who were married to the Chinese. The woman trades Last Bride as an Order. The definition of a self-ordered bride is a form of self and body exploitation carried out by the existence of the Human Trafficking group or syndicate network or syndicate, which initially gave the mode of mere seduction promising the victim a prosperous life. Cases of Trafficking in Persons are also included in Extraordinary Crimes so that the handling is specific or different from general crimes. Based on this case, this study aims to determine whether the ordered bride fulfills the criminal act of trafficking in persons. This research produces or shows the results that the ordered bride is included in TIP because it meets the requirements of the process, method, and purpose of exploitation. One of the three cases is not fulfilled by ordered marriage cases so that the perpetrators can be punished and are entitled to legal protection. The Palermo Protocol itself has the character of complementing several aspects of the conventions within the union of nations that have organized transnational crimes. One of the keys to understanding the existence of this Palermo protocol is to introduce three interrelated things. Three of the elements themselves are elements of the process, method, and also.
