Abstract

Hak bekerja bagi pengungsi sering kali menjadi hak yang tidak terpenuhi hal ini dikarenakan dilatarbelakangi banyak factor. Pemenuhan hak bekerja bagi pengungsi merupakan salah satu hak yang telah diatur dalam pasal 17 Konvensi 1951 tentang status pengungsi sehingga hak ini perlu diberikan, namun dalam hal pemenuhannya hak bekerja sering kali diabaikan banyak pengungsi yang tidak diperbolehkan bahwa terlibat dalam kegiatan yang berpenghasilan baik itu dalam berbisnis, ataupun bekerja. Indonesia sebagai negara yang tidak ikut meratifikasi Konvensi 1951 tentang status Pengungsi dengan tegas melarang seorang Pengungsi untuk bekerja dan terlibat dalam kegiatan yang berpenghasilan lewat Peraturan Dirjen Imigrasi Nomor IMI-1489.UM.08.05 Tahun 2010 pengganti Peraturan Nomor 0352.GR.02.07 Tahun 2016 tentang penanganan Imigran Ilegal. Sehingga pengungsi yang berada di indonesia tidak bisa mendapatkan penghasilan. Maka diperlukan suatu mekanisme hukum untuk memberikan perlindungan terhadap pengungsi dan pencari suaka yang berada di Indonesia sehingga mereka bisa mendapatkan haknya sebagai manusia. Penelitian ini merupakan penelitian yuridis normatif yang menggunakan metode pendekatan perundang-undangan dan juga pendekatan konseptual serta menganalisis suatu peraturan perundang undangan.
