Abstract
This act of abortion continues to occur in the community even though the abortion is illegal to do. Abortion is the act of terminating a pregnancy by removing the consequences of conception before the fetus can live outside the womb. The purpose of this study is to focus on conveying understanding and knowledge regarding the protection of children's rights against abortion according to positive law in Indonesia. using normative research methods studying legislation and conceptual, and using primary, secondary and tertiary legal sources. Marriage includes the basic needs of every human being whose goal is to form a happy family or household and marriage has the goal of having offspring and children is a mandate given by God Almighty, even children are called the most valuable assets. In Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, it is stated that a Child is someone who is not yet 18 (eighteen) years old, including children who are still in the womb. Law No.36 of 2009 concerning Health provides a regulatory dispensation on abortion based on signs of a medical emergency and pregnancy resulting from sexual harassment. However, in the Criminal Code regulating abortion, it is very clear that it is opposed for any reason and under any circumstances because the act of abortion is an act of murder that results in the loss of life. But in Islamic law there are some scholars who say they allow abortion but there are also those who do not allow abortion. Therefore, it is necessary to know that this abortion has been regulated in Indonesian positive law and Islamic law, but in this regulation there are problems with norms that shape the enforcement of rules that are not in harmony with the perpetrators of these crimes.
