Abstract
The government has the power to regulate all aspects of people's lives through its authority. This condition then causes the government to need the freedom to act on its own initiative and discretion which is then known in administrative law as the concept of discretion. However, the exercise of discretion is also prone to acts of abuse of authority and arbitrariness which can result in a criminal act of corruption as regulated in Article 3 of the Law on the Eradication of Corruption Crimes. The purpose of discretion is for the public interest or the benefit of the community so that if the discretion is exercised for other than the public interest or the benefit of the community, then the discretionary action can be qualified as an abuse of authority which can have implications for criminal acts of corruption if there is malicious intent.
