Abstract

Anak konflik hukum berkewajiban bertanggung jawab atas perbuatan pelanggaran/kejahatan yang dilakukan, namun juga berhak mendapatkan rehabilitasi diantaranya rehabilitasi sosial. Sebagaimana Sistem Peradilan Pidana Anak telah mengatur diversi dan hak anak sebagai tersangka. Anak konflik hukum wajib mempertanggungjawabkan perbuatannya baik melalui proses hukum formil maupun melalui diversi. Dalam pertanggungjawaban melalui proses hukum formil maupun diversi mereka mendapatkan hak rehabilitasi sosial, rehabilitasi sosial merupakan proses refungsionalisasi dan pengembangan untuk memungkinkan seseorang mampu melaksanakan fungsi sosialnya secara wajar dalam kehidupan masyarakat. Rehabilitasi sosial adalah Tindakan yang dikenakan pada anak konflik hukum yang melalui diversi bagi anak. Bila melalui proses peradilan pidana bagi anak diatas 12 tahun, anak yang mendapatkan penetapan tindakan rehabilitasi sosial di Lembaga Penyelenggaraan Kesejahteraan Sosial (LPKS) dalam jangka waktu tertentu dengan pengawasan pekerja sosial yang dilaksanakan dibawah Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham). Hasil dari penelitian menunjukkan bahwa diversi tidak sepenuhnya berdampak positif bagi anak konflik hukum, terbukti dengan adanya pengulangan tindak pidana. Sehingga Lembaga Penyelenggaraan Kesejahteraan Sosial (LPKS) telah gagal untuk membentuk anak konflik hukum menjadi lebih baik. Dan anak konflik hukum yang melakukan pengulangan tindak pidana tidak dapat didiversi sesuai syarat diversi yaitu bukan pengulangan tindak pidana.
