Abstract

Freedom of expression is an important element in democracy. The implication of this international recognition is that freedom of expression is a fundamental right in life that is guaranteed and protected by the state. Freedom of expression is a human right (HAM) is the crystallization of various value systems and philosophies about humans and all aspects of their lives. With the existence of Article 27 paragraph (3) which contains legal norms in the form of prohibitions to distribute, transmit and make accessible electronic information in which there is an element of insult and/or defamation. This article was born as a form of protection against social media crimes that can lead to an insult or defamation of someone. This article makes people choose to be reluctant to express their opinions or criticisms both orally and in writing, especially through electronic media because of the many cases that are ensnared by this article. This also results in different interpretations of judges on the unclear provisions of Article 27 paragraph (3). Then this article is considered an article that limits freedom of expression. By using a normative legal research method, with a conceptual approach and a case approach. And with the analysis in this study using deductive, which puts forward legal reasoning, one of which uses legal interpretation to get a concrete conclusion. So that it results in a conclusion that Article 27 paragraph (3) of the ITE Law was born on the basis of reaching a legal problem regarding the crime of defamation in cyberspace, this article is not an article that limits freedom of expression directly or through cyberspace. In addition, to resolve the problems of this article, it is also necessary to make improvements in terms of law enforcement and the prevailing culture in the community regarding the use of social media. So that when these improvements are made later, the purpose of the existence of Article 27 paragraph (3) of the ITE Law will be realized.
