Abstract

The existence of a vague norm begins with the provisions of the UUPA Article 18 regarding the feasibility of providing compensation. By referring to the provisions of Article 18 of the UUPA, Law Number 20 of 1961 concerning the Revocation of Land Rights and Objects on it, the nature of justice in the provisions of Article The 9 laws are not fully explained, until the enactment of the provisions of Article 1 point (10) and Article 2 letter (b) of Law Number 2 of 2012 concerning Land Procurement for Development in the Public Interest which states that compensation is a fair compensation. and deserves the rightful party. The existence of these legal problems found two problems, namely (1) fair and appropriate compensation in land acquisition for development in the public interest based on a justice perspective, (2) the concept of fair and appropriate compensation arrangements in land acquisition for development in the public interest based on a justice perspective. These problems are discussed using normative legal research and using statutory, historical, conceptual and philosophical approaches. It can be found that the land acquisition legislation has not been able to explain the provision of compensation in a fair and proper manner. This includes the principle of fairness in the provision of compensation for land acquisition, in essence, is still pragmatic in nature with the provisions for compensation that have been determined by the government. This shows that the provision of compensation must refer to the theory of justice, the theory of expediency and the theory of legal certainty in order to realize the nature of a prosperous legal state based on Indonesian Socialism and Pancasila. These findings can be used as a basis for compensation based on fairness and appropriateness in addition to the existence of no difference in the class of holders of land rights and the value of guarantees for protection and legal certainty in the provision of compensation for land acquisition, namely the addition based on civilized human values by elevating their dignity and based on in essence the needs of a balanced, useful, prosperous to provide space in the next life as well as the value of social justice based on Pancasila.
