Abstract

A nominee agreement is an agreement that has no specific regulation in the Civil Code (KUHPerdata), but grows and develops in the society. This name-borrowing agreement is included in a special agreement or often called an inominaat agreement. This research is motivated and carried out with the aim of describing the arrangement of the name borrowing agreement (nominee) as a form of agreement in money lending that has developed and is carried out by the society today. The research method uses normative legal research. Based on the research findings, it is known that there is no specific arrangement for the name borrowing agreement regulated in the law (KUHPerdata). An agreement can be considered valid from a legal point of view as long as the parties can properly perform the agreement in accordance with the validity of the agreement and the legal provisions of the loan agreement provided for in the Civil Code.
