Abstract

Undang – Undang Nomor 16 Tahun 2004 mengenai kejaksaan, adanya definisi atau pengertian dari Deponering yakni kepentingan umum, kepentingan dalam hal ini yakni kepentingan negara, bangsa dan kepentingan masyarakat lain yang tercantum pada pasal 35 (c). deponering ini sendiri adaah pelaksana dari asas oportunitas yang dimiliki oleh jaksa yang memiliki tujuan tersendiri yakni penyampingan perkara, namun dalam regulasi atau aturannya masih belum jelas sehingga mengakibatkan kekaburan norma karena tidak adanya batasan khusus mengenai makna kepentingan umum, maka yang dikhawatirkan adalah timbulnya penyalahgunaan kewenangan yang dilakukan oleh jaksa dan adanya salah tafsir dalam penetapan deponering. Rumusan yang diajukan sebagai berikut 1. Apa makna frasa kepentingan umum didalam deponering berdasarkan pasal 35 (c) Undang – Undang Nomor 16 tahun 2004 tentang kejaksaan republik Indonesia. 2. Bagaimana kriteria kepentingan umum sebagai syarat deponering untuk mewujudkan keadilan dalam penegakan hukum. Metode penelitian yang digunakan adalah metode penelitian normatif dengan menggunakan 2 pendekatan: pendekatan Perundang – undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah makna frasa yang dimaksud, lebih mengutamakan kepentingan bersama daripada kepentingan pribadi, serta dalam penerapannya jaksa agung harus mendapatkan pertimbangan dari badan kekuasaan Negara yang ada kaitannya dengan masalah tersebut dan kriteria dalam mewujudkan keadilan bagi penegak hukum, maka dalam mengambil keputusan untuk menggunakan deponering ini, jaksa harus berkoordinasi dengan MA, MK, DPR, Presiden.
