Abstract
Indonesia is a country consisting of various groups of indigenous peoples who inhabit various regions in Indonesia. Indigenous peoples have customary law that regulates ownership of the land where they live, known as ulayat land law. Indonesia as the umbrella of the unitary state of the Republic of Indonesia has laws regarding land and its arrangements, known as the Basic Agrarian Law Number 5 of 1960. One of the regions in Indonesia that has special regulations regarding land is West Pasaman Regency. In West Pasaman there was a conflict between the PTPN VI Ophir company and the indigenous peoples regarding the application of the Basic Agrarian Law Number 5 of 1960 concerning ulayat land which was converted into Cultivation Rights. This research is formulated in the research problem of legal certainty of returning land of ex-use rights to indigenous peoples in West Pasaman Regency, West Sumatra Province. The method used in this research is normative legal research, namely by collecting sources of legal materials related to the topic of this research. The legal material is then analyzed by comparing it with other legal materials and then drawing conclusions. The results showed that based on the Basic Agrarian Law Number 5 of 1960, the regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency number 5 of 1999 concerning Guidelines for the Settlement of Problems with Customary Rights of Customary Law Communities and the Law of the Republic of Indonesia Number 22 of 1999 concerning Regional Government It was found that the customary lands of the indigenous peoples which were used as Cultivation Rights legally and convincingly could be returned to the indigenous peoples of West Pasaman Regency.
