Abstract

Indonesia as a law country should be able to preserve country sovereignty and not be tempted by power or wealth in upholding justice. The research probles was the social assistance funds provision that did not meet the requirements for the funds allocation and the amount received by the society. The research purpose was to discover how effective the death penalty is and the human rights perspective on the death penalty sentence against coruuption perpetrators in the social assitance funding. This research utilized a descriptive qualitative method using data from laws and two approaches, the statue approach, and library research. The research results indicated that the death penalty, according to the law, was one of the criminal law goals that was first established: safety, justice between people and interests, which are presently being discussed with associates in the criminal law field. Pancasila argues that there are siginificant reasons for those who agree to use the death penalty. One of them, maintaining the death penalty in Indonesia is very important. The death penalty helps protect the welfare and safety of society by reducing what is classified as a severe crime and applying the third and fifth principles. It means Indonesian unity and social justice for all Indonesian people. Then each person is inducted on the common dignity and values that belong to God Almighty according to consciousness. The development of humanity as a personal and social being is born. Therefore, every person has the right to protect themselves if they find a threat or attack directed at them for their life safety.
