Abstract

This thesis discusses the rights of same-sex marriage in terms of the legislation of the Republic of Indonesia Number 39 Year 1999 About human rights. According to the author, marriage is a right of every human being as being free in select and specify their rights and should be high esteem by others. Marriage rights that every human being, must uphold high and protected by the State one is same-sex marriage. Same-sex marriage is a marriage that became a controversial subject in the middle of the community. The development of same-sex marriage began with the presence of the LGBT community are developed enough and mengingikan same-sex marriages to be legalised in Indonesia. However, efforts to legalize same-sex marriage opposition both from getting the community and legislation. See existing problems, then writing this thesis stated purpose into the juridical normative and research using the Statute approach Approach by means of identifying and discussing the provisions in Act No. 1 of 1974 Years Marriage, Act No. 39-year 1999 about human rights, Act No. 2005 12 years of marriage, the law of the Republic of Indonesia number 12 of the year 2005 Concerning the authentication of the International Covenant On Civil And Political Rights ( The International Covenant on Civil and Political Rights), the principles of Yogyakarta Year 2008 on the principles of the enforcement of international human rights Law in relation to sexual orientation And Gender Identity and using approach Conceptual Approach The conclusion obtained from the discussion in this thesis is the same-sex marriage is a thing which is very related to the human rights of every person. Therefore, everyone has the right to vote and determine the spouse in terms of marriage although the couples are same-sex couples. Based on the right of same-sex marriage, then the Government should change the understanding of marriage according to article 1 of the Act of the Republic of Indonesia number 1 Year 1974 about marriage and for the community incorporated in LGBTIQ group can follow various seminars to law enforcement supply in understanding human rights in the area of same-sex marriage.
