Abstract
In this modern era, advances in information technology, electronic media, and globalization occur in almost all fields of life. Technological advances marked by the rise of the internet can be operated using electronic media such as computers. With regard to defamation, Article 27 paragraph (3) of Law Number 11 Year 2008 jo. Law Number 19 Year 2016 Regarding Electronic Information and Transactions (hereinafter referred to as ITE Law) mentions a prohibition for anyone who intentionally and without the right to distribute and / or transmit and / or make accessible Electronic Information and / or Electronic Documents that have charge of insult and / or defamation. The provisions of Article 27 paragraph (3) and Article 45 paragraph (1) of the ITE Law do not mention the definition of what is meant by defamation or defamation. In connection with the community's concern regarding Article 27 paragraph (3) of the ITE Law, a judicial review has been conducted on it to the Constitutional Court by the public. The contents of the offense for defamation in Article 27 paragraph (3) of the ITE Law can only be prosecuted if there is a complaint from a person or victim, known as a complaint offense confirmed by the decision of the Constitutional Court number 50 / PUU-VI / 2008. In the Criminal Code it is formal offense and material offense, whereas in the ITE Law it is only offense. Defamation in the ITE Law has the principles and objectives contained in Article 3 and Article 4 of the ITE Law.
