Abstract

Deputy Regional Head is one of the elements contained in the system of regional government. However, to date, the legal position of the deputy head of the region is considered unconstitutional. Because the deputy head of the Region is not clearly regulated in the 1945 Constitution. However, in the relevant law, it has regulated the legal position and its very minimal duties and authority. This research is intended to answer several problems that arise, including: What is the authority of the Deputy Regional Head in Government in Indonesia? What is the legal position of the deputy regional head as a substitute for the regional head who is serving a period of detention or being temporarily unavailable? To answer this problem, this study will analyze the main issues through a normative juridical approach, which focuses on various legal rules as well as the central theme of this study. This writing uses the literature study method, namely studying supporting literature materials, articles and archives relating to the subject matter. The results of the study were answered as follows, the legal position of the deputy head of the region was regulated in the provisions of article 63 paragraph (1) of Law number 9 of 2015 concerning amendments to the two laws number 23 of 2014 concerning regional government which states that each region is led by a regional head and assisted by the deputy head of the region. the duties and authorities of the regional head representative are obtained through the law, and the gift from the regional head. deputy head of the regional government while serving as executor of the regional head's duties, has a limited authority to act on behalf of the relevant regional head. So far, the government has not yet made regulations relating to the duties and authority held by the executor of the duties of the regional head held by the deputy regional head.
