Abstract

This thesis studies the legal protection of foreign workers who work in Indonesia. Basically, all workers must get legal rights and protection. Likewise, foreign workers who work in Indonesia certainly get legal protection. This legal protection applies if foreign workers feel the right to work is not obtained. Especially if a company has terminated the employment relationship that occurred before the end of the contract period. Termination of employment that occurs for reasons not contained in Law Number 13 of 2003 about Employment, may be sued by the foreign worker. Foreign workers who work in Indonesia are treated the same as native Indonesian workers. Foreign workers can work in accordance with work agreements that have been agreed by both parties, namely between the company and foreign workers. Foreign workers can work for a certain time which in a certain time labor agreement does not require a trial period in the employment relationship between foreign workers and employers or employers. In addition, companies that violate and terminate foreign workers before the end of the contract period may be subject to sanctions in accordance with the applicable law in Indonesia. As for what will be discussed is to find out what sanctions are imposed by the company or employer for those who terminate employment before the end of the contract period. This research uses normative juridical writing techniques in which the approach is carried out by examining theories, principles, rules and concepts. So that legal protection for foreign workers can apply and any sanctions that can be imposed on employers who lay off foreign workers before the contract period expires.
