Abstract

In the state order, the law regulates and is needed in almost all behaviors aspects of social life, because basically the law comes from the will of community behavior. Law enforcement is a crucial point in the experience of the rule of law and justice. Which is where the affirmation in the 1945 Law after the fourth amendment, which states that the Republic of Indonesia is a State of law, but in its implementation apparently has not been able to be held properly related to the mechanism or process of law enforcement, which actually has been regulated in various laws and regulations. corruption cases in Indonesia can no longer be said to only recognize the limits of who, why and how. It is not only office holders and interests that commit corruption, both in the public and private sectors, but corruption has become a very serious phenomenon. By this Corruption was born, each eradication in cases of acts that cause, criminal acts of corruption can no longer be classified as ordinary crimes but have become extraordinary crimes (KPK extraordinary) Which means, with the birth of a special institution of course do not forget the birth a legal basis or a new norm that must be formed as a legal basis for the establishment of this special institution, namely Law No.30 of 2002 concerning the Corruption Eradication Commission. This Corruption Eradication Commission Law still provides specificity that is related to certain authorities possessed by the Corruption Eradication Commission itself which is regulated from Article 7 to Article 14 of Law Number 30 of 2002. related to the implementation of criminal actions corruption that has permanent legal force status (inkracht) from a judge carried out by the Public Prosecutor at the Corruption Eradication Commission (KPK), which in carrying out executions that should be the responsibility of the Prosecutor at the Attorney General's Office, but in practice is carried out by Prosecutors acting as Public Prosecutors to Corruption Eradication Commission which is the executor in handling corruption cases.
