Abstract

In this article the author discusses the bankruptcy of a company based on Law Number 37 of 2004 concerning Bankruptcy and Delaying Obligations of Debt Payment (UUK-PKPU). The factors that cause the bankruptcy of a company in Indonesia are contained in the UUK-PKPU which requires two conditions, namely, there are two or more debtors and the existence of debts that are due and collectible. The request for bankruptcy itself can be submitted by the debtor or creditor. One example of the company discussed in this article is the bankruptcy of a telecommunications company which can be said to be one of the very large telecommunications companies namely PT. Telkomsel is declared bankrupt even though the company's assets from Telkomsel exceeds its debt. Telkomsel filed for bankruptcy by one of its creditors, PT Prima Jaya Informatika. From the bankruptcy case experienced by Telkomsel raises the pros and cons in the wider community because Telkomsel is a very large telecommunications company in Indonesia. Many people think that the meaning of bankruptcy is the same as bankruptcy. From this case, it can be judged that bankruptcy conditions in Indonesia are very easy because the current UUK-PKPU in Indonesia does not consider the minimum bankruptcy debt and the amount of assets of a company that exceeds the debt is also not considered at all when going bankrupt. in this case PT. Telkomsel. The party from Telkomsel itself was not satisfied with the decision of the Commercial Court which decided or determined the company was bankrupt, therefore the party from Telkomsel itself immediately filed an appeal to the Supreme Court. After submitting an appeal to the Supreme Court, Telkomsel won and its bankruptcy was revoked and could run its business as before.
