Abstract

There are many lost motor vehicles in every location, parking, especially motorcycles, this is because the Parking Owner always uses writing on paper or a parking ticket that contains all the loss or damage is not the liability of the Parking Owner, but the liability of the Owner vehicle, with the writing those vehicles that are lost or damaged either cars and/or motorcycles are not the liability of the Parking Owner when the service users’ uses the parking lot. With the writing that the vehicle is lost or damaged both cars and/or motorcycles as if not the liability of the Parking Owner when the service users’ uses the parking lot. Legal material that will be collected and analyzed by researchers is a normative legal research method to find norms or legal rules, legal principles and legal teachings to produce what is being faced by researchers. In the event of loss or damage to vehicles and items in the service users' vehicle while being parked which is managed by the Parking Owner, the Parking Owner should be responsible for the incident. Because the liability of the Parking Owner for the loss of a vehicle is obliged to return the vehicle to its original state, this has been regulated in Article 1706 and 1714 paragraph (1) Indonesian Civil Code, the damage or loss of a vehicle in a parking location is the liability of the Parking Owner.
