Abstract

s Article 29 of sLaw Number 42 sYear 1999 sconcerning Fiduciary sGuarantee which states the Execution,is the Execution of an executorial title by the Fiduciary Recipient, smeaning that sdirect execution scan be scarried out swithout going sthrough a slawsuit in scourt but srequires a scourt decision sand is sfinal and sbinding on sthe parties sto carry sout the decision of the decision. According to this agreement, this agreement can cancel the sagreement and swithdraw the smotorized vehicle swhich should shave been determined by the court not to forcibly take the smotorized vehicle sin sthe middle sof the road or sin scertain places with violence and sometimes with physical abuse of debtors who resist not wanting to be taken by forces. sby sthe debt scollector on orders or by a letter of assignment sfrom the financial sinstitution swhich smay sresult sin scriminal sor scivil scriminal sactions sagainst the law that can be prosecuted before a judge with a prison sentence or bodies with articles of deprivation or sarticles of smistreatment or sup to ssevere torture swhich sin the sCriminal Code Act as well as material and immoral damages claims for unlawful acts.this study,to analyze the sforced seizure sof motorized svehicles in sa juridical perspective.
