Abstract

ABSTRACT Based on Article 33 paragraph 3 of the Constitution of the Republic of Indonesia has provided the basis that the earth, water and space, as well as the natural resources contained therein are controlled by the state and utilized as much as possible for the welfare of the people. people. The basis of this decision can be seen that in the prosperity of the people is the main objective in the utilization of the functions of the earth, water and space, as well as the natural resources contained therein which are then included in Law Number. 5 of 1960 which is also called Basic Agrarian Law. In this study the author will discuss the legal strength and legal protection for holders of proof of land rights that have not been registered. Article 19 Paragraph (1) of the Basic Agrarian Law is an instruction that is directed to the Government in order to hold a Land Registry aimed at providing a guarantee of legal certainty (rechtskadaster). In the Land Registry, a document of proof of rights will be issued, called a certificate. Land title certificates are the final product of the Land Registry as proof of land ownership rights guaranteed by law and the holders of them get legal protection. In order for each landowner to get legal protection, it must immediately register his land. Before the Basic Agrarian Law was born, the community still considered Girik as governed by Government Regulation Number. 24 of 1997 concerning Land Registration and only certificates of land rights are recognized as proof of ownership of land rights. The implementation of land registration in Indonesia is being carried out by the government because it is very useful, especially in ensuring the legal force and legal protection of the land that the people own. This is evident that the community registered their land to get a certificate on the land as a valid proof.
