Abstract
Human rights can not only be enjoyed by people with perfect conditions, but also human rights are attached to people with disabilities. The mandate of human rights is to uphold human dignity and dignity in social life so that political rights are part of human rights to freely make the choices they want to lead in government. Persons with disabilities also have the political right to vote and choose who has national and international legal instruments. Law of the Republic of Indonesia Number 8 of 2016 concerning Persons with Disabilities relating to the political rights of persons with disabilities. Law of the Republic of Indonesia Number 8 of 2016 concerning Persons with Disabilities concerning persons with disabilities has the right to vote and be elected in public relations. The categories of people with disabilities are divided into 4 (four) namely physical disabilities, sensory disabilities, intellectual disabilities, and mental disabilities. One of the requirements to be a legislative candidate is "physically and mentally healthy". Psychologically, normal individuals are individuals who have high integrity between psychological (spiritual) and physical (physical) functions. Good concentration is the main capital of individuals who are able to manage and utilize their abilities optimally in carrying out activities or daily work activities in achieving organizational goals. The use of political rights for persons with mental disabilities to become candidates for the legislature raises a number of problems, on the other hand guarantees of human rights and equality of rights that must be obtained by people with mental disabilities in using political rights to be elected as members of the House of Representatives, but on the other hand people with disabilities mentally that is considered by the public to be inappropriate for decision making relating to public policy.
