Abstract
Banning communism/ideology of Marxism-Leninism became a barrier to adherents of the ideology of the Komunimse/that Marxism-Leninism is entitled to freedom of thought in accordance with his conscience. Freedom to express thoughts is the fundamental right of human beings. The State is not required to prohibit freedom of thought adherents of Komunimse/ideology of Marxism-Leninism on the basis of any kind, even under any circumstances. The State only has the authority to limit the action of citizens with positive law, not even freedom to restrict the activities of thinking into the territory of the moral law. Adherents of communism/ideology of Marxism-Leninism as a citizen has the right to obtain legal protection over its rights. Legal protection is the responsibility of the State. The extent to which the country can guarantee and protect the rights of citizens in the mechanisms and procedures of the law by the adherents of communism/ideology of Marxism-Leninism of the preventive and repressive legal protection. This study is a review of normative law penenlitian singkronasi and interpretation the presence of TAP MPRS XXV/1966 which became the legal basis for the prohibition against communism/ideology of Marxism-Leninism with the rights konstutusional adherents of Ideology Communism/Marxism-leninism.
