Abstract

Problems that often arise in the world business is that there are often “grey areas”, i.e. areas where agreements or the available rules do not yet exist or cannot provide clear boundaries. Likewise, these various available regulatory sets can never perfect and there are often loopholes that can be exploited by various persons to "play" and seek illegal profits. The abundance of variety Fraud cases in the Futures Exchange world cannot be separated from the existence of a “grey area” or various loopholes of this impenetrable rule. Fraud case that resulted in the emergence of disputes between customers and the applicable company as a business person in the futures market always appears. Based on that then the formulation of the problem that can be put forward. How to protect Is it legal for investors to transact in futures brokerage companies? And How to resolve disputes that arise between investors and futures brokerage firm? The purpose of this study is to find out how the government provide guarantees and legal protection of invested customer funds on futures brokerage companies and to find out the efforts taken resolve disputes between investors and futures brokerage firms. The research method used in this research is the approach normative juridical, namely legal research conducted by examining material library or secondary material. The main problems in this paper are the protection of funds customers in futures exchange trading as regulated in the Act No. 10 of 2011 concerning Amendments to Law no. 32 year 1997 on Commodity Futures Trading which contains about institutions futures trading supervisor, customer protection through accounts separately and about the legality of futures brokers. In addition, it also regulates how settlement of disputes that may occur between investors and the company futures broker. From this discussion it can be concluded that the security of customer funds invested in futures trading is fully guaranteed by government through various regulations and supervision of related institutions. The advice that can be conveyed is that potential investors must understand and fully understand futures trading because investing in this is a high risk investment.
