Abstract

Authority of the Badan Pengawasan Keuangan dan Pembangunan in the constitutional system of the Republic of Indonesia in order to assess the state of financial losses, it has a conflict with the norms of authority possessed by the Badan Pemeriksa Keuangan. Then the problem studied is the status of the Badan Pemeriksa Keuangan and Badan Pengawasan Keuangan dan Pembangunan in the constitutional system of the Republic of Indonesia and the competent state institutions which assessing the financial losses of the state in corruption. Based on the study of using the normative research, it can be concluded that the Badan Pemeriksa Keuangan is an institution established by the command of the Constitution of the Republic of Indonesia in 1945, which has the authority under the authority of attribution. While the Badan Pengawasan Keuangan dan Pembangunan is an institution established by Presidential Decree command, which has the authority under the authority delegation. The suggestions that can be taken is required a new law concerning the dissolution of the Badan Pengawasan Keuangan dan Pembangunan, thus further strengthen the position of the Badan Pemeriksa Keuangan. While suggestions to resolve conflicts related to the authority of the state financial loss assessment testing is required legislation by the Supreme Court on the basis of the authority of the Badan Pengawasan Keuangan dan Pembangunan and the Inspectorate agency (Superintendent) on the basis of the authority of the Badan Pemeriksa Keuangan.
