Abstract

Customary law is a habit of the ancestral traditions from ancient times until now, who has become a culture that should be on their guard, in protect and in by indigenous peoples, as well as customary rights which is one of the most powerful factors in the ndigenous peoples of Indonesia. From the aspect of life indigenous areas in Indonesia, is he characteristic of the nation of Indonesia which can be known in the international world of Indonesia, country consisting of Islands and various tribes, culture, tradition, and eligion, is the unitary State of the Republic of Indonesia (SO). Where customary Rights customary in Indonesia is indeed set in article 18 paragraph 2 B and article 28 paragraph 3 of the legislation of the Republic of Indonesia in 1945 and section 3 of the Act, that Staple of agrarian rights of BAL or customary rights are called. In the past, the future before independence and in the days of the Kingdom, and in this Archipelago, rights Alliance/ancient rights is highest over land rights in the entire country. So the customary ights of indigenous peoples of Indonesia should be in treatment by the State by means of , ogether with the community in and preserve the natural resources that exist so that the community feels is fair and sejaterah in the Government's policies are good, namely good governance (good Governence) i.e. the Government efficiently, as well as a Government hat is clean and free of corruption, Collusion and Nepotism. A condition that guarantees of process alignment, equality and balance of roles and, interlocking control between the components of Government and society.These three components that have the same elationship and equal. And the three pillars of governance, namely, Governments, the private sector, and the community should and must order that achieved prosperity on the people of Indonesia.
