Abstract
This legal drafting was wroten to found and revealed about the uses and values of evidence, definition about unus testis nullus testis, and how did the position of witness when they proved the case in the court. This evidence was very conjunctional with evidence minimum theory. This legal drafting used the normative legal search, used a case approach and combine a primary and secondary legal sources. The case which included has been analyzed after using a deductive research methode. According to crime process law, the witness statement which unsupported with the other evidence can’t reached a minimum proof limit. Meanwhile in the rape case, there is no witness except a victim who saw, listened, and feel the condition by herself. Therefore, it needs another evidence like an expert statement and clues in order to fullfill a minimum proof limit and after that it can make sure the judger for decide the defendant guilty or not guilty.
