Abstract

Housing is one of the basic human needs. Basic needs Human beings are divided into three, namely the need for clothing or clothing, food or food, and board or housing. In the case of consumer housing at the time prefer to use the services of a developer or developer in get a decent house. The reason consumers choose developer or developers in meeting the need for houses is because it is practical and expected to get a good and livable house with quality the good one. On the other hand, developers or developers sometimes build houses without paying attention to the rights of consumers to get the appropriate building quality residential consumers want. That's why it is Sale and Purchase Binding (PPJB) as evidence of a relationship between consumers housing and developers do not provide legal protection for residential consumers. This situation makes housing consumers difficulty in defending their rights related to building quality that are not in accordance with the agreement between the housing consumer and the developer. That is the background of this writing so that raises the formulation of the problem, namely how the responsibilities and obligations housing business actors to housing consumers whose rights have been impaired by the developer and what legal remedies can be taken by consumers housing for building quality that is not suitable by the developer. The legal consequences due to the inappropriate quality are: criteria for fraud and incurring losses for housing consumers. Responsibilities attached to developers or developers as actors business that harms consumers is a contractual responsibility (contractual) liability), product liability, criminal responsibility (criminal liability), and responsibility for building quality. Efforts that can carried out by housing consumers is through dispute resolution in court and out of court, can also be done through administrative channels. However, residential consumers tend to choose solutions outside court by complaining to the Consumer Dispute Settlement Agency (BPSK). The reason housing consumers choose BPSK as a solution is because it does not expensive and doesn't take long.
