Abstract
The rapid developments in the field of industry and trade is not accompanied by the same developments in the field of law. One of them is leasing sale and lease back with lessee’s land and building object that are now widely used to fulfill the company's capital. So far, the regulation of leasing is only from economic aspect, not from legal aspect, so the legislation for leasing agreement based on Book III of the Civil Code by contract freedom principle. The problems examined regarding what the concept of a sale and lease back leasing agreement with lessee’s land and building object and what the characteristics of sale and lease back leasing agreement with lessee’s land and building object. The research method is normative juridical to critically and comprehensively review sale and lease back leasing agreements with lessee’s land and building object that focus on legal studies of positive law and legal theory. The conclusion of this research is the concept of sale and lease back leasing agreement with lessee’s land and building object is a financing agreement with lessee's land and building object. Basically this agreement has the characteristics as a financing agreement with the lessor as a party that provides funds / capital and the lessee as a party that needs funds / capital. The object of the agreement owned by the lessee which is sold to the lessor, still under the lessee’s control to using or operating this object. The lessee pay the lease payment regularly. Besides that, in the leasing agreement, there is an option for the lessee to buy the object of the leasing agreement after a certain period of time agreed in the leasing agreement, or continue the leasing until the lease term expires.
