Abstract
Enactment of the amendment of the Law on Notary Position establishes a new institution called the Notary Honorary Council. Notary Honorary Council is an institution that receives delegation of authority from the Minister to carry out guidance for the Notary. The current regulations do not explicitly regulate the position of the Notary Honorary Council so that there are vague norms. The present research is conducted to find the nature of the existence of a Notary Honorary Council in the perspective of the Notary Position Act and the form of the Notary Honorary Council's responsibility for a legal flawed decision. The research method used is normative legal research using 5 (five) kinds of problem approaches, namely statue approach, conceptual approach, philosophical approach, historical approach and case approach. Based on the results of the study, it is found that the existence of the Notary Honorary Council is to provide legal protection for the position of Notary in keeping the professional secret of the Notary. The Notary Honorary Council in carrying out its duties and functions is responsible administratively and civilly for its decisions that are legally flawed. A notary who is disadvantaged from the decision of The Notary Honorary Council in which the decision is regarded as can file a lawsuit through the judiciary.
