Abstract

Every Indonesian citizen has the same rights and opportunities to work and live a decent life, but it is not matched by the availability of sufficient job opportunities, causing unemployment to increase, especially during the Covid-19 pandemic. One of the government's efforts to overcome unemployment and the scarcity of job opportunities is to place workers abroad and regulate it in the PMI Protection Law. Before leaving and working, PMI candidates must receive training and work competency certificates to increase the bargaining power and competitiveness of PMI candidates. The higher the skills possessed by PMI candidates, the higher their bargaining power and competitiveness, so regulations are needed on training financing which is included in PMI placement fees. This study intends to describe the imposition of PMI placement fees in the period before and after the Covid-19 pandemic and its legal protection. The type of research used is normative legal research based on primary and secondary legal materials, solved by statutory and conceptual approaches, then analyzed descriptively qualitatively. The results of this study indicate that there is a change in the regulation of PMI placement financing which results in welfare and legal protection for PMI. Prior to the Covid-19 pandemic, the government imposed placement fees on PMI and facilitated placement financing through the PMI KUR program. After the Covid-19 pandemic, the government freed PMI placement financing as regulated in the PMI Protection Act and followed up with PerBP2MI No 9/2020 which regulates 10 (ten) types of work that are exempt from placement fees. PMI financing regulations after Covid-19 are deemed not to provide legal protection, because they are considered one-sided and return placement financing to PMI through PMI KUR/KTA.
