Abstract

Philosophically the existence of the land is fundamental in human life. The existence of the land is seen in its functions both economically, socially, culturally, politically, legally, and in development. Land plays a central role in these fields and has a valid value to develop human life in society. This relationship is what makes it very important for the use of land in the lives of people and the State that we can see in every development in our Country urgently needs land to support the movement of government programs to organize development to achieve the goal of the 1945 virgin law, namely Article 33 paragraph 3 that in the concept of development requires land to ensure the prosperity of the people. The occurrence of conflicts on land rights exemptions in general, namely regarding compensation carried out by the government, has not fulfilled a sense of justice so that there is often horizontal conflict. In this dissertation, there are two main issues, namely: Harmonization of the Tri Hita Karana in land procurement law for development for the public interest and the legal principle of land procurement for development for the public interest based on the Tri Hita Karana in solving the above issues we use normative juridical research methods to find the rule of law, legal principles, legal doctrines to answer the legal issues faced. The Tri Hita Karana in the procurement of land for development in the public interest aims to realize the community's welfare so that there is harmonization in land acquisition for the public interest. The of Tri Hita Karana in the Regulation of Bali Province No. 3 of 2020 has not regulated the technical problems of land procurement for the public interest to realize the welfare of the community; therefore, the concept of Tri Hita Karana in rules and technical implementation must be regulated to achieve harmonization of the Tri Hita Karana because this concept emphasizes that in the procurement of land for the public interest must prioritize the concept of harmonization.
