Abstract

The Covid-19 pandemic has created in the begining 2019 an emergency status in Indonesia. Through Presidential Decree No. 11 of 2020, Indonesia has declared a health emergency status. Various efforts were made to overcome the impact of the Covid-19 pandemic. One of them is vaccination efforts. However, in the community there are pros and cons related to the vaccination. Some communities refuse to be vaccinated because there is more opinion. Therefore, this article will explain whether vaccination is a right or obligation for the community and whether vaccine refusal can be subject to criminal sanctions. This research is a legal research with a normative research type and uses a conceptual approach and a statutory approach. The results of the study show that vaccination, which was originally the right of everyone, can become an obligation considering the current emergency situation in Indonesia. This is because someone who is not vaccinated has the potential to infect or even kill other people. As for sentencing, it should be the ultimum remedium, if other institutions such as persuasive methods, socialization and even administrative sanctions related to vaccination are no longer functioning while the health emergency conditions in Indonesia are getting worse.
