Abstract

Banyaknya lahan tetap dan keperluan pembangunan fisik semakin bertambah sejalan dengan meningkatnya penduduk menyebabkan munculnya persoalan sosial dan tidak dapat dihindari. Permasalahan sosial terjadi sebab benturan keperluan akan pemerintah yang memerlukan lahan untuk pembangunan sarana prasarana dan rakyat yang tetap bersikukuh pada wewenang atas lahan yang dipunyainya. Rakyat biasanya tidak merelakan lahan yang dipunyai untuk pembangunan keperluan umum dengan alasan bahwa harga yang ditentukan oleh pemerintah sangat minim. Sebagai suatu badan yang peran utamanya ialah menyediakan lahan untuk pemerintah sebelum terdapat keperluan jadi terlihat bank tanah bisa menjadi suatu pengganti penyiapan lahan nirkonflik yang bisa diaplikasikan di Indonesia untuk menangani kekurangan lahan dalam pembangunan sarana dan prasarana. Dengan memakai cara metode hukum normatif, ini bermaksud untuk mengkaji konsep bank tanah dengan strategi perpu, konseptual dan perbandingan supaya bisa didapatkan pembangunan hukum pengelolaan bank tanah untuk merealisaskkan pengaturan kekayaan lahan tanah negara adil untuk menjamin tercukupinya rasa keadilan, ketentuan hukum, dan kegunaan hukum dimasa depan. Riset ini mendapatkan simpulan kontruksi hukum pengaturan bank tanah sebagai usaha merealisasikan pengaturan kekayaan lahan negara yang adil bisa terakhir dengan membuat suatu norma tentang bank tanah yang setara Undang - Undang. Nilai, kepastian, dan kegunaan hukum dalam pelaksanaan bank tanah wajib diletakkan dalam asas dan aturan isi rancangan Undang – Undang yang akan dibuat.
