Abstract

Dengan semakin maraknya kasus kekerasan seksual terhadap anak yang dilakukan oleh orang dewasa maka Presiden Republik Indonesia Jokowi dengan tegas menyatakan dan mendukung tentang pemberian sanksi kebiri kimia bagi pelaku pencabulan terhadap anak di bawah umur, karena efek yang ditimbulkan terhadap anak apabila dibiarkan secara berkelanjutan dapat berdampak buruk bagi kelangsungan hidupnya dimasa mendatang. Dan berefek buruk bagi generasi muda Bangsa Indonesia. Penelitian ini mengkaji tentang penerapan sanksi kebiri kimia di Indonesia apakah sudah sesuai dengan Undang-Undang Dasar 1945 dan dalam pandangan hukum pidana di Indonesia. Hasil Penelitian ini yaitu sanksi kebiri kimia dan pemasangan alat pendeteksi elektronik itu bertentangan dengan Undang-Undang Dasar 1945 karena terdapat jaminan bagi seluruh warga negara Indonesia atas perlindungan kemanusiaan terutama berkenaan dengan bebas dari penyiksaan, bebas dari perbuatan yang merendahkan harkat dan martabat sebagai seorang manusia, hak untuk hidup dan hak untuk tidak disiksa. Maka dengan adanya penerapan hukuman pemasangan alat pendeteksi elektronik dan kebiri kimia bagi pelaku kekerasan seksual terhadap anak jelas berbanding terbalik dengan amanat Undang-Undang Dasar Negara Republik Indonesia 1945. Selain itu penerapan sanksi kebiri kimia juga tidak sejalan dengan hukum pidana di Indonesia karena hukum pidana di Indonesia bukan ke arah balas dendam namun lebih ke menakut-nakuti agar pelaku tidak mengulangi perbuatannya serta mendidik orang yang pernah melakukan kejahatan untuk menjadi lebih baik dan diterima di masyarakat.
