Abstract

Trade activities are one of the main vehicles for national economic development. Trading activities will be prohibited when the goods traded are not legal goods to be traded or in other words "illegal". This is closely related to the embezzlement of smuggled goods by the State Civil Apparatus (ASN) to be resold for personal gain. In writing this thesis, the formulation of the problem can be asked as follows: 1. What are the factors that cause the weighting of the crime of embezzlement of contraband? 2. How to prevent the emergence of criminal acts of embezzlement of smuggled goods? The research method used is the type of normative juridical research using a law approach, a conceptual approach, and a case approach. The types of legal materials used are primary and secondary legal materials. The result of this research is that the criminal act of embezzlement of smuggled goods by the State Civil Apparatus (ASN) is interpreted as a criminal act of embezzlement in office, therefore a weight is placed on it. These criminal acts can be prevented by preventive measures in the form of socializing the forms, methods of prevention and reporting and supervision, in addition to repressive efforts with investigations, prosecutions, examinations, and settlement of case files, as well as other efforts in the form of raids or routine patrols.
