Abstract
Persidangan secara elektronik dalam masa pandemi Covid-19 yang sedang melanda dunia, khususnya Indonesia menimbulkan suatu permasalahan. Pelaksanaan persidangan secara online bukan dimaksudkan untuk tidak menghadirkan terdakwa akan tetapi untuk memberikan perlindungan bagi terdakwa pidana secara online. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan (statue approach), pendekatan konseptual (conceptual approach). Urgensi persidangan online perkara pidana pada masa pandemi Covid-19 sangat dibutuhkan dimasa pandemi seperti sekarang untuk memutus mata rantai penularan Covid-19 terutama cluster pengadilan. Selain itu mekanisme peradilan pidana online untuk memutuskan perkara pidana yang waktu penahanannya yang terbatas. Keberadaan mekanisme peradilan pidana yang dilaksanakan secara virtual membantu mewujudkan asas peradilan sederhana, cepat, dan biaya ringan. Pemerintah diharapkan selalu memperbarui pengaturan mengenai mekanisme persidangan, termasuk persidangan online agar pihak-pihak yang berkaitan dalam persidangan lebih mudah mengikuti jalannya sidang serta Lembaga Peradilan dalam melaksanakan persidangan online sebaiknya menggunakan fasilitas khusus yang lebih bagus demi kelancaraan persidangan online untuk menghindari terjadinya hambatan yang disebabkan oleh kesalahan teknis.
