Abstract

Pasal 2 Undang-Undang Nomor 29 Tahun 2004 Tentang Praktik Kedokteran, menentukan bahwa Keselamatan Pasien merupakan standar nilai yang mendasari praktik kedokteran. Nilai keselamatan pasien bersifat samar, sehingga dalam praktek kedokteran sering menimbulkan persepsi yang berbeda antara pasien dan dokter. Dokter sering terbentur pada kondisi yang seharusnya dapat mengupayakan penyembuhan pasien, namun untuk melakukan tindakan optimal harus memerlukan persetujuan keluarga.Uuntuk menentukan batas tanggungjawab dokter terhadap keselamatan pasien sebagai upaya mencegah terjadinya Keadaan yang Tidak Diharapkan (KTD), medication eror, malpraktik dan mal administrasi dalam praktik kedokteran, maka norma keselamatan pasien harus diberikan artikulasi makna yang jelas. Dengan Pendekatan Perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan filosofis (philosophy approach), maka dalam penelitian ini disimpulkan bahwa batas tanggungjawab dokter berdasar nilai keselamatan pasien terletak pada praktik kedokteran yang dilakukan berdasar persetujuan tindakan medis (informed consent), pada kewajiban etika dan disiplin kedokteran, serta pada tanggung jawab hukum, yaitu pemenuhan hak pasien. Untuk memberikan artikulasi makna keselamatan pasien sebagai norma yang bersifat samar, maka perlu dilakukan rekonstruksi terhadap Undang-Undang Praktik Kedokteran, dengan menambahkan klausula tentang penjelasan keselamatan pasien, yang memuat parameter keselamatan pasien sebagai pedoman batas tanggung jawab dokter, dan penetapan sanksi apabila keselamatan pasien sebagai suatu sistem tidak terpenuhi.
