Abstract

Perlindungan hukum berkaitan dengan kekuasaan pemerintah dan kekuasaan ekonomi. Berkaitan dengan rakyat, di dalam pasal 1 ayat 3 Undang-Undang Nomor 13 Tahun 2003 tentang ketenagakerjaan, pekerja atau buruh adalah setiap orang yang bekerja dengan menerima upah dalam bentuk lain. Perjanjian kerja dibagi menjadi dua diantaranya Perjanjian Kerja Waktu Tertentu dan Perjanjian Kerja Waktu Tidak Tertentu. Pengertian Pekerja Kontrak adalah yang bekerja berdasarkan perjanjian kerja waktu tertentu (PKWT), yaitu perjanjian kerja antara pengusaha dan pekerja untuk mengadakan hubungan kerja dalam waktu tertentu atau untuk pekerjaan tertentu. Apabila dalam perjanjian kerja pengusaha melakukan Pemutusan Hubungan Kerja (PHK) yaitu pengakhiran hubungan kerja karena suatu hal tertentu yang mengakibatkan berakhirnya hak dan kewajiban pekerja, maka sangatlah penting untuk melakukan perlindungan hukum terhadap pekerja/buruh tersebut. Penulis disini akan membahas mengenai permasalahan pengaturan hak-hak normatif pekerja/buruh yang di PHK dalam masa kontrak menurut UU No. 11 Tahun 2020 tentang Cipta Kerja dan bagaimana perlindungan hukum pekerja/buruh yang di PHK dalam masa kontrak. Tujuan dari penulis adalah tentunya untuk mengetahui pengaturan hak normatif pekerja yang di PHK dalam masa kontrak berlangsung serta untuk mengetahui apa saja perlindungan hukum yang diperoleh pekerja / buruh tersebut. Jenis penelitian ini telah menggunakan jenis penelitian dari hukum normatif. Hasil dari penulisan yang penulis bahas yaitu pihak yang mengakhiri hubungan kerja di wajibkan membayar ganti rugi kepada pihak lainnya sebesar gaji pekerja/buruh sampai batas waktu berakhirnya jangka waktu perjanjian kerja.
