Abstract

Kebutuhan rapid test yang tinggi tentu tidak hanya dipandang dari aspek pelayanan kesehatan semata, akan tetapi juga merupakan peluang bisnis dibidang kesehatan. Biaya rapid test yang cukup mahal menjadikan rapid test menjadi peluang bisnis yang sangat menguntungkan bagi penyedia jasa pelayanan kesehatan. Beberapa oknum telah memanfaatkan situasi dan kondisi tersebut untuk memperoleh beberapa keuntungan. Salah satu tindakan tersebut ialah dilakukan oleh oknum petugas medis PT. Kimia Farma Tbk. yang dengan sengaja mendaurulang alat rapid test, kemudian digunakan kembali kepada masyarakat yang hendak melakukan rapid test. Oleh karena itu penulis akan melakukan penelitian terkait pemidanaan pendaurulang dan pertanggungjawaban pidana pendaurulang serta penjual alat rapid test hasil daur ulang. Penelitian ini menggunakan metode normative yang dimana penulis akan mengkaji dari peraturan perundang-undangan terkait. Adapun hasil dari penelitian ini adalah perbuatan Tindakan oknum petugas medis kesehatan Kimia Farma Diagnostika di Bandara Kualanamu yang sengaja mendaurulang alat rapid test bekas dapat dikenakan pidana penjara maksimal 5 tahun atau pidana denda maksimal 2 Miliar dan pertanggungjawaban pidana para pelaku pendaurulang serta PT Kimia Farma Diagnostika akan dikenakan sanksi pidana denda dengan diperberat menambah 1/3 dari ancaman maksimal denda.
