Abstract

Virus Corona atau severe acute respiratory syndrome coronavirus 2 (SARS-CoV�2) adalah virus yang menyerang sistem pernapasan. Penyakit akibat infeksi virus ini disebut COVID-19. Infeksi virus Corona yang disebut COVID-19 (Corona Virus Disease 2019) pertama kali ditemukan di kota Wuhan, China pada akhir Desember 2019. Banyak kasus pertama COVID-19 terkait dengan Pasar Makanan Laut Huanan di Wuhan. Kasus pertama COVID-19 di Indonesia ini, didapat melalui penelusuran Kementerian Kesehatan RI. Jokowi menolak menerapkan lockdown di wilayah terjangkit pandemi. Di Dalam Penulisan ini metode yang hendak di pakai antara lain menggunakan metode pendekatan Perundang-undangan dan metode pendekatan konseptual. Pandemi Covid-19 memberikan banyak dampak terhadap segala aspek dalam kehidupan dunia seperti halnya aspek kesehatan, sosial, serta ekonomi. Dilain sektor yang tak kalah pentingnya yaitu sektor ekonomi yang menyerang pundi-pundi sumber penghasilan maupun pendapatan, terutama para pelaku UMKM yang bergantung pada kondisi yang terjadi di pasar. PPKM Darurat berlaku sebagai dampak melonjaknya kasus Covid-19. Kesimpulannya adalah perlindungan Hukum yang dimiliki oleh pelaku usaha mikro dalam kaitannya dengan kebijakan PPKM sebagaimana telah diatur dalam Peraturan Mahkamah Agung Nomor 2 Tahun 2019 yang menjadi dasar hukum dilakukannya gugatan Onrechtmatige Overheidsdaad ke PTUN. Apabila dalam lima hari tidak dibalas dan PPKM Darurat terus dilakukan tanpa disertai tanggung jawab menanggung seluruh kebutuhan hidup masyarakat di wilayah PPKM Darurat, kita akan ajukan gugatan PMH penguasa ke PTUN.
