Abstract

Maraknya peredaran daging sapi glonggongan menimbulkan kerugian bagi konsumen karena mendapatkan ketidaksesuaian kualitas daging sehingga berdampak pada kesehatan dan keselamatan konsumen ketika mengkonsumsi daging sapi glonggongan. Penelitian ini akan mengkaji bentuk perlindungan bagi konsumen dan bentuk tanggung jawab pemerintah terkait penjualan daging sapi glonggongan di pasar tradisional. Penelitian ini menggunakan medote normatif, dengan pendekatan peraturan perundang-undnagan dan pendekatan konseptual untuk menjawab rumusaan masalah pada penelitian ini. Berdasarkan hasil penelitian, bentuk perlindungan hukum bagi konsumen atas ketidaksesuaian kualitas pada daging sapi glonggongan berupa ganti kerugian yang meliputi produk, biaya perawatan, biaya pengobatan serta penuntutan pidana. bentuk perlindungan hukum bagi konsumen tersebut diatur dalam Pasal 19 UU Perlindungan Konsumen tentang pertanggungjawaban pelaku usaha dan Pasal 8 UU Perlindungan Konsumen tentang larangan bagi pelaku usaha. Dalam hal tanggung jawab pemerintah terkait peredaran daging sapi glonggongan, dilakukan upaya penanggulangan baik dengan hukum pidana (Upaya Penal) maupun tanpa hukum pidana (Upaya Non Penal). Dalam Upaya penal, upaya penyelesaian sengketa dilakukan melalui pengadilan dengan melakukan penunutan secara administratif maupun pidana. selain itu, dalam upaya penal juga dapat dilakukan di luar pengadilan melalui BPSK atau LPKSM dengan 3 (tiga) tata cara penyelesaian, yaitu Konsiliasi, Mediasi dan Arbitrase. Sedangkan Upaya Non Penal yang dilakukan pemerintah sebagai bentuk tanggung jawab adalah dengan melakukan penyuluhan atau sosialisasi kepada masyarakat, razia bersama aparat penegak hukum lain, bertindak secara tegas dan pengetatan pengawasan pada sektor hulu yaitu rumah potong hewan.
