Abstract

Dalam pengiriman barang yang dipesan oleh konsumen melalui marketplace, diperlukannya pelayanan jasa dengan kurirnya, seringkali kurir berstatus sebagai mitra yang berasal dari perjanjian kemitraan yang lahir dari asas kebebasan berkontrak (freedom of contract). maka perusahaan tidak berkewajiban dalam memberikan perlindungan berupa keselamatan kerja, jaminan sosial dan lain sebagainya dan dalam marketplace menyediakan beberapa metode pembayaran salah satunya adalah COD (Cash On Delivery) atau pembayaran ditempat, namun beberapa fakta hukum yang terjadi kurir malah menjadi korban dalam layanan ini, karena konsumen merasa ditipu akibat barang yang dipesan tidak sesuai dan melukai kurir hingga mengancam nyawa kurir, salah satu contoh kurir berstatus mitra adalah gojek dalam perjanjiannya tidak terdapat klausul keselamatan kerja, dan tidak menutup kemungkinan terjadi pada kurir berstatus mitra lainnya, rumusan yang diajukan sebagai berikut, 1. Bagaimana perlindungan hukum terhadap kurir mitra dalam layanan cod, 2. Apa akibat hukum dari tidak diaturnya hubungan kemitraan dalam undang – undang ketenagakerjaan. metode penelitian yang digunakan adalah penelitian hukum normatif (normative legal research) yakni penelitian untuk menemukan aturan hukum dengan 3 (tiga) pendekatan yaitu pendekatan perundang – undang (statute approach) pendekatan konseptual (conseptual approach) dan studi perbandingan (comparative approach), hasil dari penelitian ini adalah berdasarkan pasal 27 ayat 2 dan berdasarkan kepada asas itikad baik yang telah dilakukan oleh kurir, seharusnya perusahaan layanan jasa memberikan perlindungan hukum berupa keselamatan pada saat melakukan transaksi melalui COD dan Akibat dari tidak diaturnya hubungan kemitraan dalam undang – undang ketenagakerjaan adalah kurir tidak bisa mendapatkan perlindungan penuh seperti pekerja dalam perjanjian kerja, berbeda dengan negara inggris yang telah mengubah status kurir mitra menjadi karyawan yang berhak mendapatkan perlindungan pada hak – hak normatifnya.
