Abstract

Negara demokrasi dengan kedaulatan rakyat juga memberikan kesempatan kepada rakyatnya untuk berpartisipasi secara langsung dalam kegiatan pemerintahan. Partisipasi masyarakat dalam pemerintahan akan dicapai dengan diberikannya hak atas kebebasan berekspresi di Indonesia, terutama setelah amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Kebebasan berpendapat dapat dilakukan melalui media social dengan adanya akses internet. Namun beberapa tahun yang lalu, terjadi aksi unjuk rasa di daerah Papua serta Papua bagian Barat yang mengakibatkan Kemenkominfo melakukan pemblokiran akses internet. Sehingga dari problematika ini diambil rumusan masalah (1) apa bentuk tindakan pemerintah yang digunakan untuk menjelaskan isi Pasal 40 ayat (2) Undang-Undang No. 19 Tahun 2016. Penelitian ini memakai metode penelitian yaitu yuridis normative. Penelitian ini memberikan hasil bahwa pemerintah melakukan pemblokiran internet dengan mengeluarkan Siaran Pers No. 154/HM/KOMINFO/08/2019 di hari Senin, tanggal 19 Agustus 2019 selama suasana di Papua masih belum kondusif. Pemblokiran internet yang dilakukan pemerintah tersebut diperpanjang dan dibuka secara bertahap pada Senin, 09 September 2019 berdasarkan Siaran Pers No. 175/HM/KOMINFO/09/2019.
