Abstract

Kekerasan seksual merupakan kejahatan terhadap kemanusiaan yang harus segera teratasi yangrentan menjadi korban adalah anak dan perempuan. Disisi lain, penanganan kejahatan kekerasan seksual seringkali menyerang korban.Selain darip enangananan yang tidak berperspektif korban,kesadaran masyarakat dan aparat penegak hukum mengenai pemulihan korban masih sangat minim. Masyarakat masih beranggapan bahwa korban kekerasan seksual justru merupakan sebuah aib. Sedangkan peran penting masyarakat dan aparat penegak hukum dalam upaya pemulihan korban dan penanganan kekerasan seksual sangat dibutuhkan. Pentingnya aturan dan penanganan kekerasan seksualyang berperspektif korban agar mencegah dan menghindarkan kriminalisasi terhadap korban. Banyak korban yang sulit memperoleh akses dalam mencari keadilan,selain sulitnya akses, para korban juga sering terkendala bukti dan faktor lain yang mempersulit korban. Korban masih harus dibebankan pada bukti bukti yang sulit diberikan.Selai nitu,pemulihandanhak-hak korban masih sering diciderai akibat aturan aturan yang tidak berpihak padakorban kekerasan seksual. Sehingga sangat diperlukan payung hukum yang mumpuni untuk melindungi korban kejahatan kekerasan seksual.Rancangan Undang-Undang Penghapusan Kekerasan Seksual yang kini diubah menjadi RUU Tindak Pidana Kekerasan Seksual hadir sebagai upaya pembaharuan hukum dalam melindungi masyarakat dari kekerasan seksual.Dalam RUU TPKS mengupayakan sanksi yang dapat memberi jera pada pelaku juga merehabilitasi dan lebih memperhatikan hak–hak korban. Penelitian ini bertujuan mengetahui urgensi pengaturan kekerasan seksual dalam mengatasi kejahatan kekerasan seksual dari perspektif korban.Hasil penelitian menunjukkan bahwa hukum positif di Indonesia masih belum dapat memberikan payung hukum yang mumpuni,tidak memperhatikan hak–hak korban dan kurang menunjukkan keberpihakan terhadap korban,sehingga pentingnya pembaharuan hukum dan pengesahan RUU Tindak Pidana Kekerasan Seksual sangat diperlukan dalam upaya penaganan kejahatan kekerasan seksual.
