Abstract

Adapun tujuan diadakannya penelitian ini adalah untuk mengetahui bagaimana upaya perlindungan hukum dalam merek yang tidak terdaftar dalam UU Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan untuk mengetahui bagaimana bentuk iktikad baik dalam pendaftaran merek menurut ketentuan dalam UU Nomor 20 Tahun 2016 Tentang Merek dan indikasi Geografis. Itikad baik dalam pendaftaran merek merupakan awal dari diajukannya permohonan pendaftaran merek dan merek terkenal di Indonesia. Hal ini juga sesuai dengan Pasal 4 Undang-undang nomor 15 tahun 2001 yaitu merek tidak dapat didaftar atas dasar Permohonan yang diajukan oleh Pemohon yang beritikad tidak baik. Penelitian ini diharapkan memberikan pengetahuan umum yang dapat memberikan gambaran yang jelas tentang itikad baik dalam pendaftaran merek terkenal di Indonesia. Penelitian ini menggunakan metode penelitian yuridis normative yaitu penelitian yang mengkaji suatu peraturan perundang-undangan dikaitkan dengan permasalahan yang diteliti. Untuk mendapatkan perlindungan dalam pasal 52 UU Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis menambah ketentuan mengenai permohonan pendaftaran merek yaitu mengenai permohonan merek. Hendaknya di dalam undang-undang merek pengertian asas itikad baik dalam pendaftaran merek lebih diperinci pengertian dan kriterianya, penerapan Itikad Tidak Baik Sebagai Alasan Pembatalan Merek Menurut Undang-Undang Nomor 15 Tahun 2001, bertujuan untuk mengetahui adanya penerapan persamaan pada pokoknya dan itikad tidak baik dalam suatu gugatan pembatalan pendaftaran merek. Alasan terjadinya suatu pembatalan pendaftaran merek yang didasarkan pada persamaan pada pokoknya dan itikad tidak baik serta hal-hal yang dibuktikan pada persamaan pada pokoknya sama dengan yang dibuktikan pada itikad tidak baik dalam suatu gugatan pembatalan terhadap pendaftaran merek sehingga dapat lebih jelas dipahami ruang lingkup dari pengertian asas itikad baik sebagai salah satu alasan dalam melakukan pembatalan terhadap merek. Sehingga dalam aplikasinya dapat lebih jelas dan tegas penegakan hukumnya.
