Abstract

Perkembangan jaman yang sangat cepat, membawa dampak pada kemajuan teknologi serta sektor-sektor pendukung lainnya. Manusia sebagai pemeran utama dalam sistem kehidupan, tentu dituntut untuk terus berkembang pula mengikuti perkembangan yang terjadi pada teknologi dan sektor lainnya, terutama sektor perekonomian. Wujud nyata kemajuan dalam sektor perekonomian salah satunya berupa kegiatan pinjam meminjam yang dapat dilakukan tanpa diperlukan ruang pertemuan antara kreditur dan debitur atau dilakukan secara online, akan tetapi muncul banyak permasalahan penyimpangan-penyimpangan yang dilakukan oleh pinjaman online yang beroperasi di Indonesia terkait dengan penunjukkan pihak ketiga sebagai penjamin piutang debitur, yang kemudian tidak sesuai dengan peraturan perundangan yang ada di Indonesia. Oleh karena permasalahan tersebut, peneliti tertarik untuk meneliti terkait dengan penyimpangan terhadap peraturan jaminan perorangan dalam praktik pinjaman online, yang kemudian diteliti menggunakan metode penelitian normatif yuridis dengan pendekatan perundang-undangan dan pendekatan konseptual. Sehingga diharapkan hasil penelitian ini dapat bersifat lebih obyektif.
